Terms and conditions

The terms on which MAJORVY sells, rents and books.

Draft — not legally effective

Every highlighted slot below is a fact only the operator knows, or a decision only a Spanish consumer-law adviser can make. Until they are filled this page is excluded from search engines and must not be linked from a contract.

Who you are contracting with

Your contract is with Sebastian Herrig, not with your hotel. The hotel provides the access point and receives a commission; it is not a party to the sale.

Experiences and transfers operated by third parties are marked as such, with the operator named on the product page. PARTNER_CONTRACT_MODEL

Prices and payment

All prices are in euros and include Spanish VAT at the applicable rate. The price shown at checkout is the price charged.

Payment is taken at the time of ordering through Stripe, by card, Apple Pay or Google Pay. Your order is confirmed once payment is completed — not when the browser returns to our page.

Delivery

Items we stock ourselves are delivered to your hotel within four to six hours of a confirmed order. Rentals booked for a future date are delivered on the morning the rental starts.

Delivery is to your room door or to reception, as your hotel prefers. If we cannot reach you we leave the order with reception.

Rentals, deposits and damage

Rented equipment remains our property. A refundable deposit is charged with the order where the product page says so, and returned once the item comes back undamaged.

DAMAGE_LIABILITY — the rule for loss or damage beyond normal wear.

We collect rentals at the end of the rental period. Items not returned are NON_RETURN_RULE.

Cancellation and the right of withdrawal

WITHDRAWAL_RIGHT

This section is deliberately unwritten. Under the Spanish consumer code the fourteen-day withdrawal right applies differently to goods, to rentals, and to leisure services supplied on a specific date — the last of these is generally excluded. Getting it wrong in either direction is a real risk, so it needs an adviser rather than a plausible-sounding paragraph.

Liability

LIABILITY_LIMITATION

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, and statutory consumer rights.

Governing law

Spanish law applies. JURISDICTION Consumers may also bring proceedings in the courts of their own place of residence, and this clause does not remove that right.

Open questions for counsel

  • The withdrawal right is the single most important open item. It differs for retail goods, rentals and dated experiences.
  • Whether partner experiences are sold by us as principal or brokered as agent. This changes who is liable and how VAT is charged. The operator's intent is agent: issue_invoice already names the partner as the seller of their line, and the product page, the basket and the invoice now all name them. What is not settled is whether that is enough. Two things point the other way and need an answer: we set the price and we take the payment, and a court may treat whoever presents as the trader as the trader whatever the small print says.
  • The Stripe layer asks the same question again. We collect every payment into our own account and pay partners by transfer afterwards, so we are the merchant of record and we own the disputes. Direct charges, or on_behalf_of on a destination charge, is the lever that moves that — it is a decision about liability, not a payments detail.
  • Partial rectification: we now issue a corrective invoice carrying only the refunded line, negated, referencing the original and keeping its line numbering — a rectificativa por diferencias, in its own MVR series and in the same hash chain. Confirm that is the form you want rather than substitution, where the corrective restates the whole invoice at its corrected figures.
  • Deposits are charged with the order and refunded on return, rather than authorised and released as a card hold. Confirm that is acceptable as described, and confirm the VAT treatment of any amount retained for damage — the deposit itself is not taxed, but a retention may be consideration.
